Marrying a Disbelieving (Kafir) Man

The phenomenon of interfaith marriage is currently rife, especially the marriage of a "Muslim woman" (muslimah) to a non-Muslim man. Ideally, a Muslim woman with strong faith would not consent to marry anyone but a Muslim man with good religious commitment. It can be asserted that any Muslim woman who agrees to marry a man who does not share her faith is a Muslim woman with the worst Islām and Iman (faith). Despite this, many women who claim to be Muslim are willing to marry men outside their religion. We do not know whether they do this simply out of ignorance or because they intend to defy the Shari'a of Islam. The question is, what is the status of a marriage entered into by such a Muslim woman?

Consensus of the Scholars (Ijma')

The scholars are unanimous that it is not lawful (halal) for a Muslim woman to marry a non-Muslim man. This applies whether the man is from the Jews or Christians (Ahl al-Kitābiyyun) or from any other religion. This has reached the level of consensus (ijma') among all Islamic scholars from various madhhabs (schools of jurisprudence), so it is not permissible for anyone to contradict it at all. Therefore, if any contemporary opinion permits such a marriage, it is certainly a deviation and misguidance, or an act of defiance that can lead to disbelief (kufr).

Imam Asy-Syafii said,

وَلَمْ يَخْتَلِفْ النَّاسُ فِيمَا عَلِمْنَا فِي أَنَّ الزَّانِيَةَ الْمُسْلِمَةَ لَا تَحِلُّ لِمُشْرِكٍ وَثَنِيٍّ وَلَا كِتَابِيٍّ، وَأَنَّ الْمُشْرِكَةَ الزَّانِيَةَ لَا تَحِلُّ لِمُسْلِمٍ زَانٍ وَلَا غَيْرِهِ فَإِجْمَاعُهُمْ عَلَى هَذَا الْمَعْنَى فِي كِتَابِ اللّٰه

"As far as we know, Muslims do not differ on the matter that a Muslim fornicatress is not lawful (to marry) a pagan polytheist (mushrik wathaniy) or a person of the Book (kitābiyy), and that a polytheist fornicatress is not lawful for a Muslim fornicator or any other Muslim. Their ijma' (consensus) on this matter is consistent with the meaning found in the Book of Allah." (Al-Umm V/159)

If a Muslim fornicatress is not lawful to marry a disbelieving man, then a Muslim woman who has never committed fornication is even more strictly not lawful to marry a disbelieving man. Therefore, the status of a marriage between a Muslim woman and a non-Muslim man is invalid (bāṭil) and is considered an act of zinā (fornication/adultery) if the marriage continues to be upheld.

Imam Ibnul Mundhir said,

أَجْمَعُوا عَلَى أَنَّ عَقْدَ الْكَافِرِ عَلَى نِكَاحِ الْمُسْلِمَةِ بَاطِلٌ

"They (the scholars) agreed (ijma') that the marriage contract (‘aqd) between a disbelieving man (kāfir) and a Muslim woman is null and void (bāṭil)." (Al-Isyraf ‘ala Madzahibil Ulama V/253)

 

Evidence & Reasoning

This consensus of the scholars is not without evidence; rather, it is built upon many explicit and implicit proofs from the Qur'an and the Sunnah. The most striking evidence on this matter is the word of Allah in Sūrah Al-Mumtaḥanah:

يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا جَاءَكُمُ الْمُؤْمِنَاتُ مُهَاجِرَاتٍ فَامْتَحِنُوهُنَّ اللّٰهُ أَعْلَمُ بِإِيمَانِهِنَّ فَإِنْ عَلِمْتُمُوهُنَّ مُؤْمِنَاتٍ فَلَا تَرْجِعُوهُنَّ إِلَى الْكُفَّارِ لَا هُنَّ حِلٌّ لَهُمْ وَلَا هُمْ يَحِلُّونَ لَهُنَّ

"O you who have believed, when the believing women come to you as emigrants, examine them... If you ascertain that they are believers, then do not return them to the disbelievers; neither are the believing women lawful [to marry] to the disbelievers, nor are the disbelievers lawful [to marry] to them..." (QS. Al-Mumtaḥanah: 10)

This verse clearly and absolutely prohibits the marriage of a believing woman (mu'minah) to a disbelieving man (kāfir) regardless of the reason. The claim that this verse applies only during wartime is unfounded, as it was revealed when Rasulullah and the Companions were under a peace treaty with the Quraysh of Mecca (the Treaty of Hudaybiyah), not during war.

Implicitly, the ruling is supported by the word of Allah:

وَلَنْ يَجْعَلَ اللّٰهُ لِلْكَافِرِينَ عَلَى الْمُؤْمِنِينَ سَبِيلًا

"...and never will Allah grant the disbelievers a way [to prevail] over the believers." (QS. An-Nisā': 141)

The implication of this verse is that Allah will never grant the disbelievers dominance or authority over His believing servants. When a believing woman marries a disbelieving man, she is placed under the dominance and authority of her husband. In Islam, the husband is the leader (imām) of his wife, and she is commanded to be obedient to him. It is impossible that Allah would permit His believing female servant to marry, then submit and obey a disbelieving man who is His enemy.

This is consistent with the general prohibition against polytheists (mushrikūn) marrying believing women:

وَلَا تُنْكِحُوا الْمُشْرِكِينَ حَتَّى يُؤْمِنُوا وَلَعَبْدٌ مُؤْمِنٌ خَيْرٌ مِنْ مُشْرِكٍ وَلَوْ أَعْجَبَكُمْ أُولَئِكَ يَدْعُونَ إِلَى النَّارِ

"And do not marry [your women] to polytheistic men (al-mushrikīn) until they believe. And a believing slave is better than a polytheist, even though he might impress you. Those invite [you] to the Fire..." (QS. Al-Baqarah: 221)

Furthermore, this ruling is reinforced by the consensus among the Ṣaḥābah, narrated by 'Umar bin Al-Khatthab:

إِنَّ الْمُسْلِمَ يَنْكِحُ النَّصْرَانِيَّةَ، وَلَا يَنْكِحُ النَّصْرَانِيُّ الْمُسْلِمَةَ

"Indeed, a Muslim man may marry a Christian woman, but a Christian man may not marry a Muslim woman." (AR. 'Abdur Razzāq in Al-Mūṣannaf: 10058, etc.)

 

Final Conclusion

It is clear and certain that the marriage between a Muslim woman and a disbelieving man, regardless of his religion, is forbidden (haram). This is established by the consensus of the scholars and supported by evidence from the Qur'an, the Sunnah, and the ijma' of the Muslims. Such a marriage is null and void (bāṭil) and is considered zinā if it is maintained. Those who permit this type of marriage are deviant and misleading individuals whose opinions violate the unanimous and certain ijma' of the entire Islamic nation.
